Registering "UK" Domain NamesSevernserve Ltd - Terms of registration and usePreamble: Initial selection of a UK domain name, and collection of your contact details etc for submission to Nominet - Nominet is the UK domain registry that ultimately control the registration and use of UK domain names of which Severnserve ltd is a member - and thus authorised by Nominet.to register domain names in accordance with their terms and conditions, (which can be seen on our website) , and also at: http://www.nominet.org.uk/uk-domain-names/registering-uk-domain/legal-details/terms-and-conditions-domain-name-registration Our terms and conditions applying to the registration of "UK" domain names ( .co.uk, .uk, .org.uk, etc) are as follows: Initial selection of domain name, and our collection of the necessary informaton from you ( name of registrant, contact details, address, email etc) All domain names registered by Severnserve are actioned by personal interview only. In this way - we can verify that your details are correct, and that the domain name you have requested is one that is most suitable for your business (or personal) operation Also - you agree that any domain provided by Severnserve can only be hosted by us. Should you wish to host elsewhere, this means that we cannot protect your interests in controlling the domain usage direct for web or email content.
Allowance for future changes to domain name registration practices The domain name system and the practice of registering and administering domain names is continuously evolving. You must be aware of this, and as a result, Severnserve may modify this Agreement as necessary from time to time to comply with any agreements by which Severnserve may be bound. We will notify you of these changes by e-mail or in writing to refer You to the amended provisions. Continued use of the registered domain name for either email or webhosting or both, constitutes acceptance of this Agreement and any amendments. By registering a "UK" domain name(s) with Severnserve, you are also entering into a contract with nominet who is the controlling authority for the registration of UK domain names. Nominet terms and conditions can be found on our website, (See nominet terms and conditions on top level "domains" menu navigation) and also on nominet's Website at: http://www.nominet.org.uk/uk-domain-names/registering-uk-domain/legal-details/terms-and-conditions-domain-name-registration If at any time, you do not agree to or abide by these terms and conidtions, your sole remedy is to request that your domain name registration be cancelled or transferred to a different domain name registrar.
UK Domain Name Registration Severnserve has been granted the right by nominet ( as a "tag holder") to register names with the toplevel domains such as: .co.uk, .uk .org.uk, .ltd.uk .plc.uk top-level domains. Nominet oversees the .co.uk, .org.uk, .ltd.uk and .plc.uk top-level domains. When you register a domain with Severnserve' after the receipt of domain name registration information from You, Severnserve will submit the information to the nominet registry, who will also verify that the details you have provided ( name /address etc ) are correct. You can see this by going to the "whois" service eihter on our website , or at nominet.org.uk
Correct registration and subsequent use of the domain You specifically agree that : to the best of Your knowledge and belief, neither this registration of a domain name nor the manner in which it is directly or indirectly to be used infringes the legal rights of a third party and, further, that the domain name is not being registered for nor shall it at any time be used for any unlawful purpose whatsoever. By registering or renewing a .uk top-level domain and agreeing to these terms & conditions, You agree that You have read and agree to: Nominet terms & conditions If You are registering the domain for a third party, You warrant that the third party for whom you register the domain name have read and agree to the Nominet Terms & Conditions - and that the third parties name appears as the registrant of the domain -and those third party's details are dislcosed to Severnserve PRIOR to the domain name being registered. In respect of Severnserve providing domain name registration Services to You, You agree to pay Severnserve, prior to the succesful registration of the desired domain name the agreed annual fee for initial registration and subsquent annual renewals. Our prices for registration and renewal of domain names may change from time to time -and we will inform you of these changes as and when they occur by email or direct contact. We will not register your domian name, nor make any hosting of the domain name live - until Severnserve receives cleared funds in payment of the registration fee. If however, by prior aggreement - Severnserve registers a domain name in anticipiation of payment, Severnserve will not activate hosting of that domain until cleared funds are received in repsect of payment of the agreed fee If payment is not received within 90 days of the domain being registered - then Severnserve will cancel the domain registration.In that event you will still be liable for the registration fee. In general - all fees for domain registration (and hosting thereof) for the complete year of operations must be prepaid and are non-refundable. The subsequent and following years of registration of the domain and its use form a new annual contact - again subject to all these terms in full - for each and every year. Payment for domain registration must be made either by cheque, bank transfer, or by us collecting payment by direct debit - in which case Severnserve will provide you with a direct debit mandate form.
Term This Agreement shall remain in full force for one year from the date of your domain name registration(s) as agreed. If you decide to renew your domain registration with us on the anniversary date - then these terms and conditions will then re-apply in full for the following year, and so on - until you decide not to continue. If you do decide to cancel part way through a year of contract, then no refund will be given
Annual Renewal of domains Becuase a domain is not "owned by you" ( it is merely "leased" from Nominet via Severnserve who acts as your Nominet agent) then: The domain then can be registered by someone else. So - to avoid this happening - Severserve operates a postive renewal system. That is: Your domain will automatically renew for a subsequent period. If you wish us NOT to renew your domain for a subsequent period, then you MUST inform us in writing either by email to domains@7serve.net, or by post to our address as shown on our website, www.7serve.net Automatic renewals are not refundable and it is Your responsibility to ensure valid contact and payment details are provided to Severnserve at all times. If for any reason renewal fails, this can lead to suspension or eventual cancellation of the domain. Severnserve' domain renewal process is automated, however, it is Your responsibility to check that Your renewal has been successful within one month of the renewal date. You will automatically be charged for the renewal of the domain 30 days prior to its expiry. To check the registration status of .uk domains - you can do this using our "whois search", or the whois search at nominet.org
Ownership of data You agree and acknowledge that Severnserve owns the following: (a) all database, compilation, collective and similar right, title and interests worldwide in the domain name database; Outside of your rights, Severnserve does not have any ownership interest in Your specific personal registration information.
Transfer of ownership The person named as the registrant shall be the owner of the domain name. You agree that prior to transferring ownership of Your domain name to another person, You shall require that person to agree in writing to be bound by all (and act accordingly with) - the terms and conditions of this Agreement. Your domain name will not be transferred until we receive these assurances in writing.
Domain name dispute policy You agree to be bound by the Domain Name Dispute Policy (the "Dispute Policy"), as amended from time to time, which is hereby incorporated and made a part of this Agreement by reference. The Domain Name Dispute Policy can be found at nominet.org.uk
Information You are required to Submit As part of the registration process, You are required to submit to Severnserve and keep updated the following information in connection with Your application for domain name registration: (a) the domain name to be registered; You shall provide and maintain updated information at all times with Severnserve. Additional Information Maintained about Your Registration In Addition to the information You provide, we maintain additional information relating to Your domain name registration, including: (a) the original creation date of the registration; Obligations Relating to Data Provided by You
Registrant Data You must not knowingly provide poor quality Registrant data. Opt out of whois:
Limitation of liability You agree that Severnserve shall, under no circumstances, be liable for any special, indirect, incidental, punitive, exemplary, or consequential damages resulting from loss of profits, arising out of or in connection with this Agreement, even if Severnserve has been advised of the possibility of such damages, and in particular Severnserve will not be liable for the following: (a) suspension or loss of Your domain registration; Severnserve shall not, under any circumstances, be liable or responsible for any errors, omissions or other actions by the registry administrator arising out of or related to Your application, receipt of, or failure to receive a domain name registration. Severnserve's maximum aggregate liability shall not exceed the greater of: (a) the total amount paid by You for registration of the domain name
Idemnification of Severnserve You agree to defend, indemnify and hold harmless Severnserve and the registry administrator, including Severnserve and its employees, directors, officers, representatives from and against any claim, action, suit, demand, loss, damages, costs (including reasonable legal fees, expert witness fees and expenses), or other proceeding related to or arising out of the registration or use of the domain name. This indemnification is in addition to any indemnification required under the Dispute Policy. You also agree that in the event a domain name dispute arises with any third party, You shall indemnify and hold Severnserve harmless pursuant to the terms and conditions contained in the Dispute Policy.
Representations and warranties You represent and warrant that: (a) all information provided in connection with Your domain name registration is accurate; and You acknowledge and agree that all domain name registration Services provided to You by Severnserve are provided on an "as is" basis. Severnserve makes no representations or warranties of any kind, express or implied, in connection with this Agreement or its domain name registrations Services, including but not limited to warranties of merchantability or fitness for a particular purpose. Severnserve makes no representation or warranties of any kind that registrations or use of domain name under this Agreement will immunize You from challenges to the domain name registration or from suspension, cancellation, or transfer of the domain name to You.
Breach and revocation Severnserve reserves the right to suspend, cancel, transfer or modify Your domain name registration in the event that: (a) You breach this Agreement; You further acknowledge and agree that Your domain name registration is subject to suspension by any registrar (including Severnserve) administering procedures to correct mistakes by Severnserve, another registrar or the registry administrator in administering the name or for the resolution of disputes concerning the domain name You also agree that Severnserve shall have the right in its sole discretion to suspend, cancel, transfer or otherwise modify a domain name registration after the expiration of seven (7) calendar days prior written notice, or at such time as Severnserve receives a properly authenticated order from a court of competent jurisdiction, or arbitration award, requiring the suspension, cancellation transfer or modification of the domain name registration. You acknowledge and agree that: (a) providing inaccurate information;
Guarantee You acknowledge that registration or reservation of Your chosen domain name, does not confer immunity from objection to either the registration, reservation, or use of the domain name.
Terms and conditions of .uk purchase Please note that registering a "uk" domain name also qualifies you for the ".uk" equivalent - which ix automatically reserved until 10th June 2019, This quallfication for the ".uk" equivalent remains in force until 10th June 2019 - for as long as the domain remains registered to you. If at any time you decide not to renew your existing qualifying domain, the reserved .uk equivalent will automatically become available for registration by others.
